EXTRA-JUDICIAL SERVICES IN THE FIGHT AGAINST CAPITAL LAUNDERING AND THE DEVELOPMENT OF PUBLIC POLICIES ON HUMAN RIGHTS
Abstract
This work presents part of the results of a master's investigation in progress at the Centro Universitário de João Pessoa - UNIPÊ with the objective of discussing the importance of extrajudicial services in the fight against money laundering, considering that they are constitutional institutions that have much to contribute to the scenario of Public Policies on Human Rights throughout the Federative Republic of Brazil. In this study, we will address the constitutional attributions of extrajudicial services, also called Notaries, the National Council of Justice and public entities to combat money laundering in Brazil and the important legislative mechanisms to combat socioeconomic inequalities. The investigation will be carried out based on a bibliographic and legislative analysis and on concrete cases promoted by the legislative instruments of public policies in the fight against the laundering of assets. Initially, clarifications will be made on the constitutional attributions and the realization of extrajudicial services. In addition, public policies will be addressed jointly with the Public Administration in the framework of the fight against the crime of laundering assets and the implementation of which the contributions and actions of public and private entities, together, can materialize the realization of Human Rights throughout Brazil.
